Charging Affidavit
On 25 January 2026, at 2037 hours, Westover Division officers responded to 2401 Elmin Street, residential area, in reference to shots-fired call for service. The 911 caller advised they heard multiple shots being fired in the area. Officers circulating nearby located the victim, John Glenn Martinez 03/16/1999, lying next to vehicle with multiple gunshot wounds. The victim was pronounced deceased at 2058 hours by Medic.
Detectives photographed and processed the scene and located several 9mm discharged cartridge casings in the roadway. A cell phone was in the victim's possession was seized as evidence. Detectives also noted sealed bag of food from McDonald's that was located on the ground near the victim.
Detectives spoke with witness who advised he was on the phone with the victim at the time of the shooting and stated the victim was having issues with someone named Kelvin and had been threatened by Kelvin while completing orders for DoorDash on the day of the incident.
The witness provided a Whatsapp phone number that he knew belonged to Kelvin.
The victim's phone was forensically analyzed and detectives located conversation in the phone between the victim and Kelvin.
The messages revealed the victim owed Kelvin money.
Detectives responded to the McDonald's and were able to review surveillance footage that showed Kelvin and the victim having face-to-face encounter in the lobby. The backplate and slide of tan handgun is visible in Kelvin's right jacket pocket. The victim then leaves the McDonald's in his vehicle.
After receiving his order, Kelvin enters silver Honda Odyssey minivan and drives away in the direction of the victim's vehicle.
Several street cameras were checked and detectives observed the victim's vehicle being followed by the silver Honda Odyssey through multiple intersections and outbound towards the incident location.
Several minutes later the cameras show the suspect vehicle heading inbound from the incident location. license plate reader later captured the tag on the vehicle as NJ AS9-VLX.
Detectives were notified by members of CMPD's criminal apprehension team that the vehicle's tag had hit on license plate reader system in Mississippi. Detectives reached out to several law enforcement partners in Texas and distributed state-wide BOLO for the Honda Odyssey.
On 28 January 2026 at 2146 hours, the suspect vehicle was located by officers with the Mesquite Police Department, high-risk felony stop was conducted and the suspect was taken into custody. The suspect was
identified as Kelvin Javier Molina Garcia DOB 05/13/1995. tan, 9mm Taurus handgun was located in bag during probable cause search of the vehicle.
R/O believes there is probable cause to charge Kelvin Javier Molina Garcia with Murder.
