Murdered Over a Parking Space

CMPD has ID'd the two victims of Wednesday's shooting at the Country Club Apartments as GILBERTO GOMEZ RUIZ (deceased) and DEYVID CARDONA (still hospitalized). 

According to the police affidavit, David Simpson shot both men from behind. "The suspect walks up behind the victims without being noticed and fires two shots, striking them both". 

Apparently there was an ongoing dispute over a parking space at the apartments between Ruiz and Cardona and Simpson's girl friend Shameka Scott. 

There are no reserved parking spaces at Country Club Apartments. Shameka apparently didn't like the "Mexicans" Parking near her apartment.  


CMPD's Officer Affidavit:

On July 29, 2026, officers were dispatched to 2338 Dunlavin Way in reference to an Assault with Deadly Weapon call for service. Upon arrival, officers located Victim #1 and #2 suffering from apparent gunshot wounds. Victim #1 was pronounced deceased by Medic on scene at 0202 hours, and Victim #2 suffered significant injuries requiring surgery from a gunshot wound.

Detectives located video surveillance footage that shows Victim #1 and Victim #2 walking away from their parked car, going into their apartment. The suspect walks up behind the victims without being noticed and fires two shots, striking them both. 

Victim #1 falls to the ground, and Victim #2 flees inside the apartment. Victim #2 described the suspect as tall, thin black male.

Detectives interviewed witness who stated they were standing on the sidewalk near 2328 Greencrest Dr when they heard gunfire. A short time later, the witness observed black male run past them toward vehicle parked in front of 2415 Greencrest Drive, Apt. F. The witness stated the male got into a vehicle and left the scene.

Detectives learned that earlier that evening the victims had parked their red Ford Explorer in parking space in front of 2415 Greencrest Dr, Apt F. While they were parked there, juvenile occupants of apartment confronted the victims, telling them they can't park there. Then female occupant of apartment F, Shameka Scott, also had confrontation with the victims where 911 was called. Officers were dispatched to this location twice after 911 calls from both parties. 

Detectives learned from speaking with various neighbors that there had been history of disputes over this parking spot between the residents of the Apt and persons who parked there.

Detectives obtained video footage from approximately 20 minutes before the shooting that shows Scott outside with her boyfriend, who was later identified as David Simpson, DOB 12/27/1996. 

Footage shows the Ford Explorer that the victims were driving drive by Simpson's residence on Dunlavin Way. Detectives can see on the video that Simpson reacts angrily to seeing this vehicle and immediately goes inside his apartment. 

Approximately ten minutes later, Simpson can be seen walking outside carrying black bag. Simpson is then seen running towards where the victim's vehicle is parked carrying a weighted down black bag.

At 0140 hours, two shots can be heard. Approximately thirty seconds later, Simpson is on camera trotting away from the direction of the shooting, messing with the weighted down black bag in his hand back towards Apt F. Simpson then gets into car and drives away.

Detective processed the scene, collecting two spent 7.62 rifle rounds. 

Simpson is convicted felon in the State of North Carolina. Simpson was charged with committing First Degree Murder on December 21, 2013. Simpson pled guilty to the lesser offense of Voluntary Manslaughter, a Class felony punishable by 38 to 160 months in prison, on August 27, 2015, in Mecklenburg County Superior Court and was sentenced to 73 to 100 months in prison.

Based on the above facts, this detective believes there is probable cause for 1st Degree Murder, Attempted Murder, ADWIKISI, and Firearm by Convicted Felon.

Cedar's Take: Shameka and the juveniles should be charged as accessories.

    3. Complete arrogance, especially in smaller towns. Officers watch leadership, and they always seem to use their power against someone or have a grudge against someone. Heck, look at meck Sheriff for perfect example.
      I've known many a man pulled repeatedly, harassed, stalked and surveilled and it always started with an ex, or dating someone's ex.
