John Jacik Death - CMPD Officer Guilty of Misdemeanor Sentenced to One Year Unsupervised Probation

Local Television News Reporter Continues Her Excellent Play by Play Coverage of CMPD Officer Barker Trial via Twitter:

TRIAL FOR OFC. BARKER continues: Attorneys discussing “culpable negligence” with the judge. 

This is the term the jury asked for clarity on 

Judge will bring jury back in to get further explanation from them as to what they’re struggling with 

Jury asks to go back to the jury room to discuss how they want to clarify the specifics of their question 

The jury is back in court and they are putting an additional definition for culpable negligence on the screen for them to take notes on 

#BREAKING- Judge says jury has a verdict 

Jury: GUILTY of misdemeanor death by vehicle. 

Prosecutor: Family of Short not in court. "This has been extremely hard on them." 

Says John Jacik wanted to be here to speak but is not.

Defense: Says Barker is scheduled to be married December 28th. 

"He does regret what happened and is remorseful for what happened to the family... we still contend he was responding to a priority 1 call." 

Says he's never had driving disciplinary actions. 

Barker is speaking. Apologizes to the family, says he's been "on probation" for the past 5 years going job to job while he's been on unpaid leave from CMPD. 

Prosecutor: We offered Barker a plea deal 5 years ago, but this was his choice. 

Sentencing:

12 mos unsupervised probation

50 hours community service 

12 mos suspension drivers license

  1. The ADA is an Ass - The DA brought this case to trial knowing it was a long reach. And to think Charlotte's elected officials don't understand why CMPD is having a hard time recruiting or retaining officers. Props to the Judge for having enough backbone to tell the Meck DA "Up Yours"

    Maybe a message to drunk college boys look both ways before crossing a street and maybe you'll get to grow up?

  2. Definitely part of the reason I left, no support, not from the mayor, not from city council, not from Jennings, not from his command staff, and barely any at the divisional level.

    All I can do is sit back and watch the city burn and pray my friends left can hide until 30. Good luck boys.

  3. Jury had a tough call. I think they did what they thought they needed to do. It was a mistake but nothing criminal about it.

    I've been stumbling drunk at some point I'm sure maybe on shore leave but I'd damn sure sober up hearing more than one siren and seeing a bunch of lights coming down the street. I just the booze drugs combo is a bad thing.

  5. Why would he suspend his drivers license for 12 months? How is he supposed to work? I think the jury compromised. It isn't involuntary manslaughter and they didn’t want him to walk because going 100mph down a city street seems fast. Now, what about a pursuit? They can easily reach speeds of 100mph on a city street, are you going to charge every officer who gets in a wreck now?

  8. Something doesn’t smell right, after all that, why would he just resign? Why wouldn’t he fight termination, get his job back, get his back pay for 5 years, then resign?

    1. It said he is on unpaid leave. So he probably didnt resign but if he isnt getting paid he has to find something to do to make money.

  11. I’m just happy this case is finally over and we can move on. With his luck he will violate probation and get put in jail. That’s the luck of some people like hitting a drunk while driving to a call. Let go back to our daily bickering about office politics and gossip.

  12. What we need to address is not his punishment, but why he was set up by Putney in the first place. That suggests a negative workplace environment at CMPD that may be driving low recruitment and retention of quality LEO. All that legal work and settlement, and the guy was given probation? He could have been on the street answering calls or humping reports at the LEC. Sad days..

  13. Why are rank and file CFD hearing about upcoming policy changes from WSOCTV? Nothing but sounds of crickets or silence from Command Staff? Asking for a friend. The entire Command Staff should take advantage of retirement before it’s too late. But we did get our oranges and apples, so there’s that….

  15. The CFD tried to fire Crystal Eckart with a false complaint, and she won 2 mil in a lawsuit. The CMPD promoted Mike Campgania after he lied during testimony about Wes Kerrick. Why would you believe anything that comes from these places? Their recruitment paperwork isn’t even accurate.

    1. I know. I actually was in court that day when Campagnia lied. I was astonished the defense didn't shred him into pieces with it. But it just reiterated how far they were willing to go to get a conviction. So glad I left.

  16. The CFD is now allowing lateral transfers (or whatever word spin the Chief uses) because they can’t get anyone to take the test. Used to be thousands take the test, now barely 400. They lose 1/3-1/2 in each step of the process. Do the math. CFD is understaffed, moral is in the toilet. Those eligible are projecting time to just get to 50/25 and quickly hauling ass for the door. Domestic violence is tolerated and covered up, as is drinking on the job and DWI. Just stick them on light duty at Logistics counting toilet paper and fart spray until things settle down. The place is a clown car and Bozo is driving. The apples and oranges were a nice traditional touch they haven’t yet taken away. So, Happy Holiday’s, here’s an orange.

    1. u kinda have to when it’s “required” training. don’t get me wrong, theres no such thing as white privilege. but if i wanna stay employed i gotta do the required training. would love to know the back story as to why they stopped making people attend. gut says someone threatened to sue. i’ve heard some interesting stories about the class and the low brow ghetto queens teaching it.
